Council regulates roadside vendors to ensure these activities are carried out in a safe manner for road users and pedestrians. This activity means the commercial supply of goods or services on a road. Roadside vending can involve travelling from place to place on a road and the waving down of the person operating the roadside vending by a customer (mobile roadside vending) or the activity being established in one place (stationary roadside vending).   This approval does not apply to footpath dining activities.

Stationary roadside vending
Stationary roadside vending means roadside vending which is established in one place. Permit criteria applicable to this activity include:

  • The location of the operation of stationary roadside vending must not be within a five kilometre radius of a retail shop or other commercial premises which sells or provides the same or similar products or services or within five kilometres of the operation of another prescribed activity being stationary roadside vending


  • The hours of operation of stationary roadside vending must not detrimentally affect the amenity of the neighbourhood


  • The operation of stationary roadside vending must not constitute a risk to road safety.


  • Mobile roadside vending
    Mobile roadside vending means roadside vending which involves travelling from place to place on a road and the waving down of the person operating the roadside vending by a customer. Permit criteria applicable to this activity include:

  • The location of the operation, and any activity associated with the operation, must not be within a 250 metre pedestrian path of travel of a retail shop or other commercial premises which sells or provides the same or similar products or services and is open for trade


  • The operator must be ‘waived down’ in order to make a sale


  • The operator must only remain stationary for the duration of the sale of goods or the provision of services to customers. The operator must not wait for customers


  • The operation of the mobile roadside vending must not involve a vehicle other than a car or a commercial vehicle


  • The operation of mobile roadside vending must not constitute a risk to road safety


  • The products must be ready for sale, or available in a short period, for example pre-packaged goods, coffee.


  • The applicant for an approval must be a legal entity, for example, person(s) or a company.
    Note - a business name or shop name is not a legal entity and cannot be the approval holder.
    The following activities require an approval from Council:
    • The displaying, storing, depositing, placing or erecting goods, materials, articles or any other thing or substance on a roadside;
    • The commercial supply of goods or services from a place on a road; or
    • The setting upon, or bringing onto, a road of a stall, vehicle, equipment or other thing for the commercial supply of goods or services.
    The following activities do not require an approval from Council:
    • anything undertaken by a charitable, religious, non-profit community, educational or political entity.
