Overview

 

Council is required to monitor the standard of operations in accommodation premises to ensure the health and safety of occupants. This is achieved by regulating particular types of accommodation premises.
The applicant for an approval must be a legal entity (eg person(s) or Company).
Note - a business name or shop name is not a legal entity and cannot be the licence holder.

The following types of accommodation require an approval from Council:
Previously Gatton:
accommodation provided for payment at premises within the area on a basis involving sharing of facilities by the persons for whom the accommodation is provided.

Previously Laidley:
Commercial accommodation where facilities are shared
This local law does not apply to accommodation requiring registration under the Residential Services (Accreditation) Act 2002 (Boarding houses and Supported Accommodation). Application under this legislation must be made to the Residential Services Accreditation Branch, Office of Fair Trading. Once you have liaised with Residential Services, please contact Council and arrange for a building compliance audit (as per MP5.7 of the Queensland Development Code) of your premises. This is a mandatory part of your application to Residential Services.

The following types of accommodation do not require an approval from Council:
Previously Gatton:
  • a community titles scheme under the Body Corporate and Community Management Act 1997;  or
  • a private home in which accommodation is provided for not more than 3 boarders; or
  • a premises excluded from the application of this local law under the local law policies.

Previously Laidley:
  • hotel or motel
  • hospital, nursing home or other institution where people are cared for on a live in basis
  • residential college or boarding school
  • religious institution
  • building unit or group titles scheme
  • a private home in which accommodation is provided for not more than 3 boarders
  • Residential Service (boarding house or supported accommodation) as defined in the Residential Services (Accreditation) Act 2002 you will need to contact the State Government Office of Fair Trading (OFT) for accreditation and registration.
