As of the 1st December 2011, Chapter 7 Part 7 of the Environmental Protection Act 1994 relating to waste management works (including the approval of waste transporters) was omitted. The omission of this part of the Act resulted in the abolition of the waste transporter approvals administered by local governments. This means that all existing waste transporter approvals ceased to have effect after 30 November 2011. There is no power for local government to issue waste transporter approvals after this date.
Local governments will now use the provisions under the Environmental Protection Act 1994 to control nuisance associated with waste management works (including the operation of waste transporters).
